ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 419, 420 of IPC, in Crime No.Not known of 2018, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the the defacto complainant and the petitioner had love affair and love each other for the last 1 1⁄2 of year and that the defacto complainant passed on five sovereign gold jewels and a sum of Rs.42,000/-to the petitioner to meet out the petitioner's sister marriage. Hence, the case has been registered for the above said offences.

3. It is submitted by the learned counsel for the petitioner is that the petitioner is innocent and that the petitioner has not committed any offence as alleged by the defacto complainant and that the petitioner's family gives consent for their marriage and prays for anticipatory bail in favour of the petitioner.

4. The learned Government Advocate (Criminal side) submitted that there is no previous case registered against the petitioner.

5. Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Aruppukkottai and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
