Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 323, 427, 446 and 506(ii) IPC in Crime No.101 of 2014 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the first petitioner is the village Panchayat President. It is alleged that one Hariharan had agreed to sell the property in question to the Villagers for a sum of Rs.10 lakhs and he has given back to the words and sold the property to the defacto complainant.
Aggrieved by this, the petitioners herein and two others have trespassed into the house and land of the defacto complainant and tied the defacto complainant in a tree and assaulted him. They have also set fire on the hut of the defacto complainant. Even in the complaint the defacto complainant stated that he had sustained heavy damages, inasmuch as all his clothes and other items have burned to fire. A https://hcservices.ecourts.gov.
Village President ought to be a role model to others and he should not lead to any feudalism and run the poor villagers by ransom. 3.Taking into consideration of serious allegations levelled against all the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Hence, this petition is dismissed.
