Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondent Nos.5 and 7 from digging the sand from New Kattalaimettu Canal Bank which flows through Palayapati therku Panchayat, Sengipatti Panchayat, Sanoorapati Panchayat, Budhalur Taluk, Thanjavur District for the purpose of road laying project under the Pradhan Mantri Gram Sadak Yojana (PMGSY) proposed from Paalayapatti West to Sanoorpatti (Sengipatti) National Highway, Thanjavur District and consequently direct the respondent Nos. 5 and 7 to restore the New Kattalaimettu canal bank to its original condition and take action against the respondent No. 7 in accordance with law within the time stipulated by this Court. Heard both sides.

2. The petitioner's grievance is that sand from the canal is being dug and taken out and used for the road laying project. The road laying project is also for public purpose.

3. We direct the seventh respondent to ensure that the width of the canal is not affected in any manner.

4. With the above direction, this writ petition stands disposed of. No costs.
