O R D E R

The petitioner/Inspector of Assessment in the respondent Corporation is facing disciplinary proceedings pursuant to a charge memo, dated 07.08.2025 that he has not maintained the PR Stationery Register properly. The petitioner, with a grievance that the documents, which have been referred by the Department in the charge memo have not been furnished to him, has submitted a representation to the respondent and also filed this writ petition before this Court, seeking a writ of Mandamus, to direct the respondent to issue all the necessary documents to the petitioner and to conclude the departmental proceedings within a stipulated time. 2.Mr.B.Ramanathan, learned Standing Counsel takes notice for the respondent and submits that this petitioner has been replied by a letter, dated 23.10.2025, permitting him to peruse the 2/6

documents referred in the charge memo.

3.This Court considered the rival submissions made and also perused the materials placed on record.

4.The petitioner, an employee of the respondent Corporation is requesting certain documents, which were referred by the Department in the charge memo, dated 07.08.2025, which was issued as against him, on certain irregularities. This petitioner can defend his case effectively only on production of those documents, which has been referred by the respondents in the charge memo. If the documents are not provided to the employee concerned upon request, the proceedings may be deemed to be vitiated due to the violation of the principles of natural justice. 5.In view of the above, this writ petition is allowed with a direction to the respondent to furnish the documents, which were referred in the charge memo, dated 07.08.2025 to the petitioner, within a period of two weeks from the date of receipt of a copy of 3/6

this order. The respondent shall ensure that the enquiry proceedings, which is kept pending on the ground of non-furnishing of the required documents to the delinquent shall be concluded within a reasonable time. No costs.
