PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.34 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/A.1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417, 376, 294(b), 323 and 506(1) IPC, in Crime No.34 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and the defacto complainant were in love and the petitioner by giving false promise to the defacto complainant had sexual intercourse with her several times forcefully and also threatened her. Hence, the complaint.

CRL OP(MD). No.4929 of 2022 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that investigation is pending. 5.Considering the seriousness and gravity of the offence alleged as against the petitioner and also the fact that investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
