Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent herein to renew petitioners Passport bearing No. L6425093 by making necessary correction in the date of birth of the petitioner as 15.03.1972 instead of 15.03.1970 in the petitioner's passport by considering the representation of the petitioner 19.02.2025 within the time stipulated by the Hon'ble Court.

O R D E R

This Writ Petition has been filed for a direction, directing the respondent to renew the petitioner's passport bearing No.L6425093, by correcting the petitioner's date of birth to 15.03.1972 instead of 15.03.1970, by considering the petitioner's representation dated 19.02.2025, within the specified time frame.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner's date of birth, as per all available records, is 15.03.1972, however, it was inadvertently mentioned as 15.03.1970 in the passport. In this regard, the petitioner submitted a representation to the respondent on 19.02.2025, requesting the necessary correction of the date of birth in his passport. The learned counsel further submitted that it would suffice if the third respondent is directed to consider and dispose of the petitioner's representation dated 2/5

19.02.2025 in accordance with the law, within a specified time frame. 4.Considering the limited scope of prayer now sought for by the petitioner, there shall be a direction to the respondent to consider the petitioner's representation dated 19.02.2025 and pass appropriate orders solely on its own merits and in accordance with law, after verifying all the necessary authorized documents substantiating the date of birth as claimed by the petitioner, within a period of three months from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondent to consider the same on its own merits.
