ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 14.09.2017, for the alleged offences punishable under Sections 4(1)(aaa), 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.182 of 2017 on the file of the respondent police seeks bail.

2.The case of the prosecution is that the petitioner was found in possession of 114 litres of Pondicherry arrack and he was arrested and remanded to judicial custody on 14.09.2017 and subsequently the case was registered for the above said offences in Crime No.182 of 2017.

3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He is no way connected with the crime and prays for bail.

4.The learned Government Advocate (Crl.Side) appearing for the State submitted that there are five previous cases against the petitioner out of which three cases ended in conviction and two https://hcservices.ecourts.gov.in/hcservices/ cases pending trial.

5.Considering the facts and circumstances of the case and gravity of the offence committed by the petitioner and since the petitioner is having five previous cases in similar nature, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
