ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused in C.C.No.155 of 2014 on the file of the Judicial Magistrate Court, Mudukulathur, Ramanathapuram District, apprehends arrest in pursuance of the Non-Bailable Warrant issued in C.C.No.187 of 2003 for the alleged offence under Sections 147, 336, 427 and 506(ii) of I.P.C and hence, seeks anticipatory bail. 2.The learned counsel for the petitioner submitted that the respondent police has filed a case against 36 accused and in respect of other accused, they have faced the trial and they were acquitted. It is further submitted that the petitioner was shown as absconding accused and he was not aware of the case filed against him in C.C.No.187 of 2003. The case was split up and the petitioner and one another accused are facing trial in C.C.No.155 of 2014.

3. The learned Government Advocate(Crl. Side) on instructions would submit that Non-Bailable Warrant was issued in the year 2002 and the other accused have been acquitted in C.C.No.187 of 2003.

4. Considering the above said facts, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Mudukulathur, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court on all future hearing dates without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

5.
