Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner is apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 506(i) of IPC in Crime No.5 of 2018 on the file of the respondent police and seeks anticipatory bail. 2.According to the petitioner, the petitioner owes only a sum of Rs.4,00,000/- (Rupees Four Lakhs Only). Whereas according to the defacto complainant the amount is much higher. 3.
Considering the facts and circumstances of the case and without going into the merits of the matter, this Court is inclined to grant anticipatory bail to the petitioner on condition that the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) to the credit of Crime No.5 of 2018, within a period of three months from the date of receipt of a copy of this order and further sum of Rs.2,00,000/- shall be deposited within a period of three months thereafter. If this condition regarding the deposit is not complied with, the anticipatory bail granted shall stand cancelled. It is made clear that it is open to the defacto complainant to withdraw the said amount also.

Judicial Magistrate, Theni and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
