ORDER : The Court Made the following order :- The petitioner is arrayed as A.5 in Crime No.216 of 2015 on the file of the respondent police, for the offence punishable under Section 399 I.P.C. r/w 25(1-a) Arms Act. The petitioner was arrested and remanded to judicial custody on 06.04.2015. He has come forward with this petition seeking bail.

2. The case of the prosecution is that on 06.04.2015 at about 03.00 a.m. when the police party was on patrol, the accused were found with aruval and iron rod and they were planning to commit robbery at Nazareth Agriculture Co-operative Bank.

3. The learned Counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side) would submit that the iron rod was recovered from this petitioner and the petitioner does not have any bad antecedent.

5. Considering the facts and circumstances, this court is https://hcservices.ecourts.gov.in/hcservices/ inclined to grant bail to the petitioner.

6.Accordingly, the petitioner is directed to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sathankulam and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. sd/- 30/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
