ORDER

The Contempt Petition has been filed to punish the contemnor / 2nd respondent for his wilful disobedience of the order passed by this Court in W.P.(MD)No.22768 of 2024 dated 25.09.2024.

2. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that in the writ petition in W.P.(MD)No.3214 of 2025, a learned Judge of this Court vide order dated 14.03.2025 directed the learned Additional Government Pleader to file a counter affidavit after directing the officials to inspect the property with special emphasis regarding availability of 45 feet or 33 feet on ground.

3. The learned counsel appearing for the petitioner as well as the learned Government Advocate (Criminal Side) appearing for the contemnor would submit that survey was already conducted and report is awaited from the concerned Tahsildar.

4. The learned counsel appearing for the petitioner would submit 2/4

that the contempt petition may be closed and after filing of the report, they would work out their remedy in the writ petition pending in W.P. (MD)No.3214 of 2025.
