Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners are apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of IPC in Crime No.12 of 2018 on the file of the respondent police and seek anticipatory bail.

2.One Ravichandran is the defacto complainant. His complaint against the petitioners herein is that the petitioners contacted him in June, and they received a sum of Rs.30,00,000/- (Rupees Thirty Lakhs Only), with an assurance that his investment will yield good returns, in instalments from the defacto complainant. Only thereafter, the defacto complainant came to know that the petitioners herein borrowed money from a number of persons. Therefore, the defacto complainant wanted to pull out of the arrangement and sought return of his invested amount. But the petitioners have been adopting an evasive approach and not only did not return the money to the defacto complainant but also closed the enterprise, which they were running. The transfer of fund from the defacto complainant in favour of the accused is established beyond doubt.

Since the said amount is to be recovered from the petitioners, custodial interrogation is absolutely necessary. 3.It is submitted by the learned Government Advocate (Crl.Side) appearing for the State that the police are presently enquiring on the allegation that many other persons have been cheated similarly. https://hcservices.ecourts.gov.

4.Taking note of this aspect, this Court is not inclined to grant anticipatory bail. Accordingly, this Criminal Original Petition for anticipatory bail is dismissed.
