ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.6, who was arrested and remanded to judicial custody on 24.04.2016 for the alleged offences punishable under Sections 147, 148, 294(b), 324 and 506(ii) of IPC r/w Section 3(1)(X) of SC & ST (POA) Act 1989, in Cr.No.120 of 2015, on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that by the order, dated 22.12.2015 made in Cr.M.P.No.2844 of 2015, the learned Sessions Judge, Tirunelveli granted interim bail to the petitioner on condition that directing the petitioner to appear before the learned Judicial Magistrate No.I, Kovilpatti daily twice at 10.00 a.m., and 05.00 p.m. Subsequently, the petitioner did not comply the condition and the interim bail was not extended.
The learned Judicial Magistrate, Cheranmahadevi issued a Non-Bailable Warrant against the petitioner and he was arrested on 24.04.2016. 3.The learned Government Advocate (Crl.side) submitted that the petitioner is having three previous cases and the case is posted for appearance of accused persons.
4.Considering the facts and circumstances of the case and also considering the fact that the petitioner is in judicial custody from 24.04.2016, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions: https://hcservices.ecourts.gov.in/hcservices/
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum to the satisfaction of the learned II Additional Sessions Judge, Tirunelveli.
(ii)the petitioner shall report before the respondent police daily twice at 10.30 a.m. And 5.00 p.m., until further orders.
(iii)the petitioner shall not tamper with evidence or witness either during investigation or trial. (iv)the petitioner shall not abscond either during investigation or trial.
(v) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
