O R D E R
This Contempt Petition is filed complaining the willful disobedience on the part of the respondent in implementing the order dated 21.06.2024 in W.P(MD)No.13210 of 2024 in true letter and spirit.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.
3. This Court vide order dated 21.06.2024, while disposing WP(MD(No.13210 of 2024 directed the respondent to consider the representation of the petitioner and pass appropriate orders in the light of the police report filed after making enquiry before proceeding to the next level or to re-consider the order of suspension issued to the petitioner.
4. The learned counsel for the petitioner submits that the order of the Court is not complied with. Accordingly, the respondent is liable for punishment under the provisions of the Contempt of Court Act.
5. Mr.N.Satheesh Kumar, learned counsel appearing for the respondent would submit that in compliance of the order of this Court dated 21.06.2024 to re-consider the order of suspension issued to the petitioner, the petitioner is re-instated into service. Admittedly, in this case, no time is stipulated by this Court to pass order by the respondent.
6. Considering the fact that in compliance of the order of this Court, the respondent passed the order on 02.08.2024 by revoking the suspension order, in our considered view, there is no wilfull disobedience in implementing the order by the respondent.
