PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to transfer the complaint in CSR No.09/2023, dated 22.01.2023 on the file of the third respondent police station to the eight respondent police against 4 to 7th respondents and other six unidentified person.

ORDER
This Criminal Original Petition has been filed to transfer the complaint in CSR No.09/2023, dated 22.01.2023 on the file of the third respondent police station to the eight respondent police against 4 to 7th respondents and other six unidentified person.
2. As per the direction issued by this Court, dated 29.03.2023, the petitioner is personally appeared before this Court and stated that because of some family issue between her brother and his wife, some unidentifiable persons came to her mother's house, assaulted the petitioner and her mother and also caused damage to the trees around that 2/5
house, over which, the above said complaint has been given and the same was registered in CSR No.09 of 2023. But without proper enquiry, the above said complaint has been closed on 22.01.2023, as if the petitioner has made an undertaking that not to take further action against her complaint.
3. The learned counsel for the petitioner would submit that the petitioner had signed in the above said undertaking under threat only. So, that she has made a representation, dated 31.01.2023 before the respondents to reopen the said complaint, but no action has been taken by the respondents till now.
4. Considering the submission made by the petitioner, the above said complaint shall be re-opened and enquired by the third respondent and complete the enquiry process within a month. Depending upon the outcome of the above said enquiry, further action may be taken either by the petitioner or by the competent authority. 3/5
5. With the above said direction, this Criminal Original Petition is disposed of.
