ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-2 in Crime No.1 of 2014 on the file of the respondent police, was arrested and remanded to judicial custody on 19.03.2015 for the alleged offences punishable under Sections 420, 120(b), 294(b) and 506(i) of I.P.C and hence, seeks bail.

2. The case of the prosecution is that the third accused namely Madhavan was running an Agency in the name and style of "SMF Fund Agency" at Thanjavur and he opened branches throughout the State subsequently. The accused Nos.1 and 2 were working as Manager and Assistant Manager in the branch office at Rajapalayam. The defacto complainant had collected Rs.1000/- from the members of self-help group to obtain loan from the said Finance Company and sent the amount in the name of the Finance Company, later, they did not disburse the loan.

3. The learned counsel for the petitioner submitted that the amount was paid in the name of the Finance Company admittedly and the petitioner is only an employee in the Finance Company. It is further submitted that the third accused, who is running the Finance Company was granted bail by this Court in Crl.O.P(MD)No.78 of 2015, vide order dated 07.01.2015.

4. The learned Government Advocate(Crl. Side) on instructions submitted that the petitioner was the Assistant Manager of the Finance https://hcservices.ecourts.gov.in/hcservices/ Company at Rajapalayam and the amount was paid by way of Demand Draft in the name of the Finance Company.

5. Considering the above said facts, I am inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate, Srivilliputhur, and on further condition that the petitioner shall appear before the respondent police daily 10.00 a.m until further orders.
