To grant an order of exemption from paying the afore Court fee of Rs.18,258/- pending disposal of the above Appeal.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for exemption from paying the Court fees of Rs.18,258/-.

2. Heard the learned counsel on either side.

3. The Insurance Company has filed C.M.A.(MD).No.1238 of 2025 questioning the award passed by the Tribunal both on the ground of negligence and quantum. While granting stay in C.M.P.(MD).No.17333 of 2025 by an order dated 29.10.2025, this Court directed the Insurance Company to deposit 50% of the award amount along with the accrued

interest within a period of four weeks. It is brought to our notice that the Insurance Company has complied with this direction.

4. In view of the above, the petitioners are permitted to withdraw 50% out of the deposit amount made by the Insurance Company along with the accrued interest in the proportionate shares as allotted by the Tribunal. On such withdrawal, there shall be a direction to the petitioners to pay the Court fees within a period of four weeks from the date of receipt of a copy of this order.

5. This petition is disposed of in the above terms.

6. On compliance with the above condition, Registry is directed to number the appeal and post the same along with C.M.A.(MD).No.1238 of 2025.
