The petitioner has come up with this Habeas Corpus Petition claiming that his son Ajithkumar, aged 25 years, is missing on and from 29.01.2022 and despite his complaint, the respondent Police have not taken any action.
2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.
3. Mr.T.Senthil Kumar, learned Additional Public Prosecutor, upon instructions, would submit that when the Laptop and Mobile phone of the detenu were scanned, various photographs were found and the respondent Police suspect that he had eloped with a 1/3
girl with whom, he had exchanged messages and has also been talking over phone. The Admit Card issued by the All India Institute of Medical Sciences to the said girl for the Nursing Officer Recruitment Common Eligibility Test (NORCET) that was to be held on 20th November, 2021 at Madurai, has also been recovered by the respondent Police from the Laptop of the detenu. The respondent Police, therefore, suspect that it is a case of elopement. The Aadhar card number of the girl is available in the Admit Card issued by the All India Institute of Medical Sciences. The investigation of the respondent Police had reached a dead end and they are unable to proceed further.
4. Mr.T.Senthil Kumar, learned Additional Public Prosecutor, would further submit that unless there is a Court order, the Aadhar Authority would not divulge the address and the mobile number linked to the Aadhar Card Number of the person.
5. Considering the above, there will be a direction to the Deputy Director, Unique Identification Authority of India, 3rd Floor, South Wing, Khanija Bhavan, No.49, Race Course Road, Bengaluru - 560 001, to disclose the address and the mobile number linked to the Aadhar card number of the person, who holds the Aadhar Card No.341055999675. The Authority is required to disclose the above details to the respondent Police, namely, the Inspector of Police, Karuppaurani Police Station, Madurai District. The respondent Police shall proceed with the investigation based on the information received and conclude the same to its logical end.
6. With the above direction, this Habeas Corpus Petition is closed.
