ORDER

This Criminal Original Petition has been filed to direct the learned Additional District and Sessions (PCR) Court, Sivagangai, to consider the bail application of the petitioner on the same day of their surrender before that Court in connection with Crime No.7 of 2026 on the file of the 2nd respondent police.

2. Since there is no adverse order passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

The learned counsel for the petitioner submitted that the 1st petitioner due to intoxication, threw the liquor bottle over the temple place, for which the de facto complainant enquired towards the 1st petitioner. Regarding the said issue the 1st petitioner along with other petitioners abusing the de facto complainant using his caste name 2/5

and attacked him with concrete stone and threatened him with dire consequences. Hence, the de facto complainant lodged a complaint before the 2nd respondent police. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Sessions Judge, Additional District and Sessions (PCR) Court, Sivagangai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.7 of 2026 on the file of the 2nd respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
