ORDER : The Court Made the following order :- The petitioner is the sole accused in Crime No.35 of 2015 on the file of the respondent police, for the offence punishable under Sections 341, 376, 511 I.P.C. r/w 3(1)(W) of SC/ST(PA) Amendment Ordinant Act 2014. The petitioner was arrested and remanded to judicial custody on 05.04.2015. He has come forward with this petition seeking bail.

2. The case of the prosecution is that the defacto complainant Lingammal, aged about 29 years lodged a complaint that the accused had waylaid and attempted to rape her.

3. The learned Counsel for the petitioner submitted that both the petitioner and the defacto complainant belonged to the same village and due to a civil dispute, he has been falsely implicated in this case. He further submitted that the petitioner is innocent and he has not committed any offence.

4. The learned Government Advocate (Crl.Side) would submit that this https://hcservices.ecourts.gov.in/hcservices/ is a case of attempt to rape of the lady belonging to the suppressed clause and the petitioner does not have any bad antecedent.

5. Considering the facts and circumstances, this court is inclined to grant bail to the petitioner.

6.Accordingly, the petitioner is directed to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Tirumangalam and on further condition that the petitioner shall stay at Trichy and report before the Cantonment Police Station daily at 10.00 a.m. until further orders. sd/- 30/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
