ORDER

The present petition has been filed for issuance of Writ of Mandamus directing the second respondent to grant permission and accord adequate police protection for the eve of Valli Thirumanam Drama, Gramiya Kalai Nikalchi and Annual Day celebration scheduled to be taken place on 26.02.2025, 27.02.2025 and 28.02.2025 respectively pursuant to the petitioner`s representation, dated 18.02.2025.

2. The learned Additional Public Prosecutor (Crl. Side) appearing for the respondents would submit that already there is a dispute pending between the parties in respect of the Temple. Thereby, the Temple administration was entrusted with the fit person and now the petitioner want to conduct festival and the same would cause law and order issue in the locality. Already this Court also granted permission to the petitioner to have a worship without any law and order issue in a private place. Now there is no space to conduct such drama in that place. they strongly objected. However, the representation of the petitioner is still under consideration and they will consider and dispose of the petition tomorrow itself.

3. One Counsel, namely, Balamurugan represented before this Court that already they filed impleading petition and after numbering the impleading petition, the petition can be disposed of. Since so far the impleading petition has not been taken file by this Court, his request cannot be considered.

4. However, this Court without affecting the rights of the parties only directed the respondents to consider the representation in accordance with law on merits. Therefore, it does not mean that this Court decided the rights of the petitioner in respect of the Temple and other related activities in his favour.

5. With the above said observations, this writ petition stands disposed of. There shall be no order as to costs. 25.02.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR Note: Issue order copy on 26.02.2025.
