ORDER

The Criminal Original Petition is filed to direct the Principal District and Sessions Court, Theni to expedite the trial in S.C.No.40 of 2009 and dispose of the same within the stipulated time fixed by this Court.

2.Heard, the learned Counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

3.The learned Counsel for the petitioners states that the present case has now been transferred to the Fast Track Court, Theni and assigned case number as S.C.No.40 of 2009. It is https://hcservices.ecourts.gov.in/hcservices/

brought to the notice of this Court that the proceedings before the lower Court is pending for a long time. It is further stated that even in the month of January,2017, the matter was posted for arguments, after closing the evidence on either sides. Despite the matter is being posted for arguments on several occasions, the matter is not yet disposed of.

4.Considering the nature of the case and the grievance expressed by the petitioner before this Court, this Court is inclined to issue the following directions:

"The Additional Fast Track Court, Theni is directed to dispose of the case in S.C.No.40 of 2009 on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order" 5.The Criminal Original Petition is allowed as directed above.
