PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the R1 and R2 herein to transfer the case in Crime No. 713/2021 on the file of the R3 police to any other police officer under the supervision of the R2 police and to file final report within time stipulated by this Hon`ble Court. ORDER

This petition has been filed seeking direction to direct the first and second respondents herein to transfer the case in Crime No. 713/2021 on the file of the R3 police to any other police officer under the supervision of the R2 police and to file final report within time stipulated by this Hon`ble Court.

2. When the matter is taken up for hearing the learned Additional Public Prosecutor would submit that the third respondent has registered First Information Report in Crime No.713 of 2021 for the offences under Sections 294(b), 323,506(ii) of IPC and Section 4 of TNPHW Act.

3. In view of the submission made, if the investigation is transferred from the file of the third respondent to any other investigating agency at this stage, the entire investigation will be spoiled.

4. Hence this Criminal Original Petition stands dismissed. However the third respondent is directed to complete the investigation and file the final report before the concerned Court within a period of eight weeks from the date of receipt of a copy of this order.
