ORDER : The Court made the following order :- The petitioner /A2, who was arrested and remanded to judicial custody on 13.03.2025 for the offences punishable under Sections 8(c) r/w 1/6

20(b)(ii)(C), 28 and 29 of NDPS Act, 1985, in F.No.48/1/07/2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that totally there are five accused in this case and the petitioner is A2, based on the secret information received, the officer of Narcotics Control Bureau, Madurai Sub-Zone, seized 445 Kgs of Ganja from the parking area of Hotel Kasi's Inn 91, 25 A Thilagar 2nd street, Nagai bye pass road, Thiruvarur, on 12.03.2023 in the vehicles of white colour Tata Safari Car bearing Reg. No.TS 08 HM 7373, one White colour suzuki Brezza car Bearing Reg.No.TS 33 H 0549 and Tofee Brown Colour Volkswagen Vento car bearing Reg.No.TN 06 T3984. Hence, the case.

3. The learned counsel for the petitioner would contend that the respondent officer have 2/6

registered a false case against the petitioner for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 28 and 29 of NDPS Act, 1985. The petitioner is an innocent and he is nothing to do with the alleged offences. He would further submit that no contraband was recovered from this petitioner and he is in judicial custody from 13.03.2025. Therefore prayed to grant bail to the petitioner.

4. The learned Special Public Prosecutor appearing for the respondent would submit that the accused persons were found in illegal possession of 445 kgs of Ganja. He would further submit that the investigation has been completed and the petitioner has no previous cases and the petitioner was also present in the scene of occurrence and caught red handed and A7 to A10 were absconding. Hence, he strongly opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made on either side, considering the fact that the quantity of contraband involved in this case is a commercial quantity and though the investigation has been completed, the petitioner was also present in the scene of occurrence and caught red handed, considering the gravity of the offences and A7 to A10 are absconding and hence, this Court is declined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Original Petition is dismissed.
