ORDER

The prayer in this writ petition is for a Writ of Mandamus, directing the 1st respondent to expedite and dispose the appeal filed by the petitioner on 26.03.2019 in Na.Ka.D5/6571/2019 within a stipulated time fixed by this Court.

2.Heard Mr.A.Arul Jenifer, learned counsel appearing for the petitioner and Mr.V.Anand, learned Government Advocate appearing for the respondents 1 and 2. Since no adverse order is going to be passed against the respondents 3 to 5, notice to them is dispensed with.

3.As against the order passed by the 2nd respondent i.e., the Revenue Divisional Officer, by his proceedings in Mu.Mu.A3/3098/2010 dated 18.02.2019, the petitioner preferred an appeal to the 1st respondent, District Revenue Officer on 26.03.2019. All that, the petitioner wants as represented by the counsel that, the said appeal if it is decided within a time frame, on merits, the petitioner would be satisfied. https://hcservices.ecourts.gov.in/hcservices/

4.I have heard the learned Government Advocate appearing for the respondents, who would submit that, the said appeal filed by the petitioner before the 1st respondent would be decided on merits and in accordance with law, within a time frame to be stipulated by this Court.

5.Considering the limited scope of the prayer sought for in this writ petition and by taking into account the factual matrix of the case, with the consent of both the parties, this Court is inclined to dispose of this writ petition, at the admission stage itself, with the following direction:

"The 1st respondent is directed to decide the appeal filed by the petitioner dated 26.03.2019 and pass orders thereon, after giving reasonable opportunity of being heard to both the petitioner as well as the private respondent viz., the respondents 3 to 5 by giving specific notice to that effect to them and final order shall be passed, within a period of eight weeks from the date of receipt of a copy of this order."

6.With this direction, this writ petition is disposed of. No costs.
