ORDER

This Criminal Original petition is filed for issuing a direction to the third respondent not to harass the petitioner and his family members.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioner states that he is residing along with his parents, wife and two children and that he is an agriculturist.

It is represented that some cases were registered against the petitioner earlier and in all the cases, the petitioner was acquitted, after full fledged trial. It was further stated that another case was registered against the petitioner in Crime No.214 of 2014 for the offence under Section 379 of I.P.C. It was also stated that the complaint is about stealing of cylinder. It is the case of the petitioner that all the cases were foisted against the petitioner and that the last one is to harass the petitioner and his family members.

4. Learned Additional Public Prosecutor however on instructions submitted that though the case was registered, there was no harassment. He further assured that no enquiry will be conducted otherwise than by due process of law.

5. Recording the said statement, the Criminal Original petition is closed. The respondents need not harass the petitioner. Even if the presence of the petitioner is required for any enquiry, the same shall also be done only after issuing summons prescribing date and time and following the Judgment of the Hon'ble Supreme Court in the case of D.K.Basu Vs. State of West Bengal.
