ORDER

This Criminal Original petition is filed for issuing a direction to the third respondent not to harass the petitioner and his family without any basis under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for respondents 1 to 3.

3. The petitioner himself admitted that he borrowed a sum of Rs.40,000/- from one Arumugam as loan on 11.07.2017. He further admitted that the said Arumugam was found missing from 31.08.2017. https://hcservices.ecourts.gov.in/hcservices/

4. It appears that the petitioner has used the ATM card of the

said Arumugam, after the complaint was registered about the missing of the said Arumugam and that he had taken some money using the ATM card. After the said Arumugam was found missing, the petitioner is a suspect. It was only in connection with the complaint, the petitioner was called for an enquiry.

5. Learned Additional Public Prosecutor however on instructions submitted that there was no harassment and that it was only in connection with the case registered, the petitioner was called for the enquiry.

6. Having regard to the factual circumstances of the case, the Criminal Original petition is closed with a direction to the petitioner to co-operate with the enquiry.
