ORDER
The petitioner, who is a retired State Government servant, is the beneficiary under the NHIS. For his heart ailment, he was admitted and took treatment in Oxymed Hospitals by incurring a sum of Rs.2,27,245/-. When the petitioner approached the respondents by way of an application on 18.12.2023 claiming medical reimbursement under G.O.Ms.No.171, he was sanctioned with a sum of Rs.32,255/- and the remaining claim has not been sanctioned and hence, the petitioner is before this Court.
2. Heard the learned counsel for the petitioner, the learned Additional Government Pleader for the respondents 1, 3 and 4 and the learned standing counsel for the 2nd respondent. 2/5
3. When the matter was taken up for hearing, the learned Additional Government Pleader submitted that as the treatment was taken in a non networking hospital and the treatment is not covered under the scheme, the petitioner entitlement is considered only under Tamil Nadu Medical Attendance Rules.
4. Since the petitioner has come to know that his claim towards the medical reimbursement under the NHIS is not accepted, he can file an appeal before the District Level Empowered Committee and work out his remedy before the said committee.
5. This writ petition is disposed of with the above direction. No costs.
