ORDER

The Petitioner had filed this petition seeking direction against the Respondent Police to give police protection to the life and limb of the Petitioner and his family members.

2.The learned Counsel for the Petitioner submits that the Petitioner is a retired Army Man. The Respondents 4 to 6 have parked the vehicles in front of the gate of the Petitioner and used abusive words against the Petitioner and his family members. Therefore, the Petitioner had given a complaint to the third Respondent. The Respondents 4 to 6 attacked the Petitioner with wooden log causing injuries on him, for which the Respondent Police had registered only CSR.

3.The learned Government Advocate (Crl.side), on instructions of the Respondents 1 to 3, would submit that based on the complaint of the Petitioner, CSR was registered. Based on the CSR, summons was issued to the Petitioner as well as the Respondents 4 to 6, but the Petitioner himself had not appeared.

4.When the Petitioner as injured is admitted in the hospital, how the Investigation Officer can register CSR, instead of visiting the hospital and find out the truth from the injured person in hospital? Registration of the case under CSR itself creates doubt regarding the conduct of the Investigation Officer.

5.Today (06.03.2024), the Superintendent of Police had furnished the F.I.R copy. The first Respondent is directed to nominate a Senior Officer to monitor the investigation, since the F.I.R was registered only after the Petitioner had approached this Court. Even though the Petitioner was attacked with wooden log by his neighbour, the Respondent Police had registered only CSR. The investigation shall be monitored by the Superintendent of Police, Dindigul District.

6.With the above said direction, this Criminal Original Petition is closed.
