ORDER

This Criminal Original petition is filed for issuing a direction to the respondents not to harass the petitioner under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioner states that he has not involved in any criminal case. It is the further case that his brother though involved in such criminal cases, under the guise of enquiry the third respondent is harassing the petitioner.

4. Learned Additional Public Prosecutor however on instructions submitted that no case has been registered against the petitioner. He further submitted that there was no harassment to the petitioner and the petitioner will be called for any enquiry only if any case https://hcservices.ecourts.gov.in/hcservices/

is registered against the petitioner.

5. The said undertaking is recorded.

6. Even if the presence of the petitioner is required for any enquiry, the same shall also done only after issuing summons prescribing date and time and following the Judgment of the Hon'ble Supreme Court in the case of D.K.Basu Vs. State of West Bengal.

7. With the above observation, the Criminal Original petition is closed.
