Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the Respondents 1 and 2 to take sincere and effective steps to ban the Aadal Padal Programs conducted throughout the State in a obscene manner based on the petitioner's representation dated 26.04.2019 and further direct them to frame necessary guidelines in this regard as per the order of this Hon'ble Court in W.P.(MD) No.19959/2018.

O R D E R

(Order of the Court was made by M.SATHYANARAYANAN, J.) The petitioner claims to be a Member of Tamilnadu Folk Artist Welfare Board and according to him under the guise of dance festival, which would be conducted during the temple festivals and occasions like that, obscene dance are being performed and it is also against decency and morality. Hence, he prays for a direction to the Respondents 1 and 2 to take sincere and effective steps to ban the Aadal Padal Programs conducted throughout the State in an obscene manner based on the petitioner's representation dated

26.04.2019 and a further direction to frame necessary guidelines in this regard as per the order of this Hon'ble Court in W.P.(MD) No.19959/2018.

2.Heard Mr.V.Sankaranarayanan, learned counsel appearing for the petitioner. Mr.A.K.Baskarapandian, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 3 and he has produced the Circular Memorandum in Rc.007301/Genl I (1)/2019 dated 09.04.2019, issued to all the Police Officers of Tamil Nadu and would submit that the said Circular has been specifically addressed to all the Commissioners of Police in Cities and all the Superintendents of Police in Districts and with copies marked to all the Inspectors General of Police in Zones and all the Deputy Inspectors General of Police in Ranges and since specific mechanism has already put in place, the petitioner can no longer have such a kind of grievance.

3.This Court considered the rival submissions and perused the materials placed before it.

4.A perusal of the abovesaid circular memorandum dated 09.04.2019 would disclose that comprehensive procedures have been framed for cultural programmes (including Aadal Paadal Programme, Music events, Mimicry show), for sports events and also for procession and for meetings.

5.In the considered opinion of the Court, in the light of the circular memorandum dated 09.04.2019, necessary things have already been put in place. Therefore, it is obligatory on the part of the concerned police officials to follow the circular memorandum scrupulously and also in letter and spirit with regard to the applications for Aadal Paadal, sports and also procession/meeting. Therefore, no orders are necessary in this Writ Petition. 6.Accordingly, the Writ Petition is closed. No costs.
