O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO/TRY/635/2025-G1 dated 13.12.2025 and direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner namely Duraipandi, S/o.Mayandi, aged about 42 years, Life Convict Prisoner PID No.100849 confined at Central Prison, Trichy.
2. It is the case of the petitioner that he was convicted by the learned Principal District and Sessions Judge, Dindigul in S.C.No.118 of 201 on 07.12.2021 for the offence under Section 302 of IPC and sentenced to undergo life imprisonment. Further he was also convicted in S.C.No.6 of 2019 for the offence under Section 302 of IPC vide judgment dated 31.01.2023 on the file of the Additional District and Sessions Court, Dindigul and he is in jail. The petitioner submitted representation seeking 21 days ordinary leave on the
ground that he want to repair his house. He further submitted that his mother died on 27.01.2024 and no one is there to look after the property, however it was rejected on the ground that there is a life threat at the hands of the first accused in Crime No.639 of 2025 registered for the offence under Section 103 of BNS. Further the Probation Officer as well as the jurisdiction police had not recommended for ordinary leave, therefore this Court finds no infirmity or illegality in the order passed by the first respondent and hence the petition is liable to be dismissed.
3.In view of the same, the petition stands dismissed. However the petitioner is at liberty to file a petition for emergency leave on valid grounds [G.K.I., J.] [R.P., J.] 19.02.2026 NCC : Yes / No Index : Yes / No Internet : Yes / No aav To:
