O R D E R

This Criminal Original Petition has been filed seeking a direction to the second respondent Police, not to harass the petitioner under the guise of enquiry without due process of law. 2.According to the petitioner, the second respondent called the petitioner alleging that he caused accident on 12.01.2025 and caused death to one person. In fact the petitioner has not involved in the accident and he denied the said allegation. However, the second respondent insisted the petitioner for enquiry as if the petitioner caused the accident.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner caused the accident, for which a complaint has been received from the defacto complainant and thereby, they conducted enquiry. For enquiry purpose, they called the petitioner and they have not harassed the petitioner as stated by him. If the petitioner's appearance is required, they will take appropriate steps in accordance with law.

4.In reply, the learned counsel for the petitioner would submit that the petitioner's vehicle has not involved in this case, in spite of that the second respondent harassed the petitioner.

5.Under the above said circumstances, it is for the second respondent police to decide whether the petitioner's vehicle was involved in this case or not after investigation.

6.Considering the nature of prayer sought for in this case, recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed. 28.02.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR To
