Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to provide relief under the Tamil Nadu Chief Minister's Public Relief Fund to the petitioner by considering the petitioner's representation dated 19.01.2022.

ORDER

Heard both sides.

2.One Thiru.Kaamil Basha died in a road accident on 08.10.2021. In this regard, Thuvarankurichi Police Station registered Crime No.400 of 2021. The petitioner seeks relief under the Tamil Nadu Chief Minister's Public Relief Fund. It is seen that the petitioner is a permanent resident of Madurai. However, it is the Revenue Divisional Officer, Srirangam who has to send the necessary proposal. 3.The Revenue Divisional Officer, Srirengam within whose the accident occurred is directed to send necessary proposal to the District Collector, Trichy. It is stated that relief will be provided on seniority basis based on the availability of funds. The petitioner might have submitted application belatedly to the sixth respondent. But then the seniority should be reckoned based on the occurrence of the accident. 3/6

4.This writ petition is disposed of in the following terms: a) The petitioner is directed to submit a representation before the Revenue Divisional Officer, Srirangam. On receipt thereof, the Revenue Divisional Office shall prepare necessary proposal for providing relief under the Tamil Nadu Chief Minister's Public Relief Fund within a period of four weeks thereafter to the District Collector, Trichy.

b) The District Collector, Trichy shall keep the proposal on his file and disburse the fund to the petitioner as per the relevant norms. I consciously refrain from quantifying the ex gratia payable to the petitioner. The petitioner's seniority will be reckoned with effect from 08.10.2021.

There shall be no order as to costs.
