The learned Counsel for the Petitioner submits that the Petitioner is the defacto Complainant in Crime No.22 of 2022 on the file of the second Respondent. He had filed this Petition seeking direction against the Respondents to complete the investigation and lay the final report before the Court concerned.
2.The learned Government Advocate (Crl.side), on instructions of the Respondents, submits that the accused 2 to 6 were residents in Delhi. They were arrested. They obtained bail on 12.02.2023 from the District Court. The first accused is still absconding. He would further submit that the investigation had almost been completed. The Police are unable to trace out the first accused. The address furnished by the Complainant against A1 is not the correct address. Therefore, there are difficulties in tracing the first accused. He would further submit that they are ready to file the final report showing the first accused as absconding accused. 2/4
3.Considering the submission made by the learned Government Advocate (Crl.side), the Investigation Officer is directed to get opinion from the experts assisting the investigation team at the Office of the Superintendent of Police, Theni, to trace out the absconding accused and to file the final report within the reasonable period of one month. The Petitioner is within his right to approach this Court for further orders. With the above directions, this Criminal Original Petition is disposed of.
