M, Thennur High Road, Thillai Nagar, Trichy West Taluk, Trichy District, forthwith in the light of the notice issued by the 1st 1/5

respondent vide his proceedings in Na.Ka.No.F1/3245/2025, dated 12.04.2025 and Section 136 of the Tamil Nadu Urban and Local Bodies Act, 1998 within the period that may be stipulated by this Court. ORDER

The present writ petition has been filed seeking a mandamus directing the respondents 1 to 3 to demolish the dilapidated and dangerous building situated at Door No.23/1 comprised in T.S.No.104/3, Block No.32 Ward. M, Thennur High Road, Thillai Nagar, Trichy West Taluk, Trichy District, in the light of the notice issued by the first respondent on 12.04.2025.

2. According to the learned Counsel appearing for the writ petitioner, she is the owner of the building and the same is in occupation of the tenants who are arrayed as the respondents 4 to 8 in the present writ petition.

3. According to the learned Counsel appearing for the writ petitioner, the building is in dilapidated condition and enclosing a certificate issued by a 2/5

Chartered Engineer, the petitioner has made an application to the respondent Corporation seeking their permission to demolish the building. Thereafter, a notice has been issued on 12.04.2025 to the landlord as well as the tenants of the building to the effect that the building has become dilapidated and therefore, the building has to be demolished. Complaining that the order of the Corporation has not been implemented, the present writ petition has been filed by the landlord.

According to the learned Counsel appearing for the writ petitioner, though notices have been issued to the tenants, so far they have not raised any objection whatsoever and the Corporation has also not proceeded further. The learned Counsel appearing for the writ petitioner further submits that one of the tenants has already filed a civil suit that they should not be disturbed unless by due process of law and the same is pending without any interim order.

The learned Standing Counsel appearing for the respondent Corporation submits that they would make inspection of the premises with a help of competent Engineers in the presence of the petitioner as well as the respondents 4 to 8 after giving due opportunity to the respondents 4 to 8, further action would be initiated.

With the above said observations, this writ petition stands disposed of with a direction to the first respondent to complete the said exercise within a period of 12(twelve) weeks from the date of receipt of a copy of this order.
