ORDER

This Criminal Original petition is filed for issuing a direction to the respondents not to harass the petitioner under the guise of enquiry for the preparation of proceedings under Section 110 of Cr.P.C., in the petition preferred as against the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioner admits that a complaint was registered against the petitioner in Crime No.313 of 2016 for the offences under Sections 294(b), 324 and 506(ii) of I.P.C., and that after filing of Charge Sheet, the case was taken on file in C.C.No.272 of 2016. It is further represented that the petitioner regularly appearing before the learned Judicial Magistrate No.II, Thiruchirappalli and several witnesses were examined in the criminal cases.

4. The petitioner's complaint is that the fourth respondent is harassing the petitioner under the guise of calling upon the petitioner for an enquiry for preparing a report under Section 110 of Cr.P.C. It is further stated by the petitioner that the fourth respondent is acting at the instigation of the defacto complainant in the criminal case which was registered as against the petitioner. The petitioner has come forward with this petition without specifying any instance of harassment, except stating that he is being unnecessarily called upon by the fourth respondent for preparing the report under Section 110 of Cr.P.C.

5. Learned Additional Public Prosecutor on instructions submitted that there was no harassment in this case. He further submitted that no further enquiry is contemplated as against the petitioner.

6. Recording the said statement, the Criminal Original petition is closed.
