ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused in Crime No.61 of 2015 on the file of the respondent police, the accused was arrested and remanded to judicial custody on 28.02.2015 for the alleged offences punishable under Sections 302, 324 and 506(ii) of I.P.C., @ 147, 120-B, 302, 324 and 506(ii) of I.P.C., and hence, seeks bail. 2.The case of the prosecution is that the deceased had earlier murdered one Ayyappan and to take a revenge, the accused have attacked him on 24.02.2015 and caused his death.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. The learned counsel further submitted that even as per the case of the prosecution, A1 had attacked the deceased and there is no specific overt act attributed against this petitioner. 4.The learned Government Advocate (Crl.side) would submit that the petitioner, by his motor bike has taken the ninth accused to the scene of occurrence and A1 to A5 had attacked the deceased and A6 to A9 were watching the movement of the deceased. 5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Tiruchendur and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m and 05.00 p.m until further orders.
