PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order issued by the 5th respondent vide his proceedings in Ref:Lr/SCADCET/Enq./2026/05 dated 10.02.2026 and quash the same as illegal insofar as placing the Petitioner under suspension is concerned and consequentially directing the respondents to permit the Petitioner to attend the classes for the 6th semester and the subsequent semesters of CSE Department in the 5th respondent College on the basis of the representation dated 04.02.2026 within the period that may be stipulated by this Court.

O R D E R
The petitioner has approached this Court challenging the notice issued by the fifth respondent / College, by which the petitioner was directed to appear before the Enquiry Officer for the purpose of conducting a disciplinary enquiry on allegations of misconduct. By the 2/8
same proceedings, the petitioner was also placed under suspension pending enquiry.
2.It is brought to the notice of this Court that a case in Crime No.437 of 2025 and a counter case in Crime No.439 of 2025 were registered on the file of the Cheranmahadevi Police Station against the petitioner and a professor of the fifth respondent College. The petitioner as well as the said professor have now expressed their willingness to withdraw the allegations made against each other. It is submitted that if the allegations are withdrawn, the jurisdictional police may take appropriate steps to close the case and counter case in accordance with law.
3.The learned counsel appearing for the petitioner submitted that the petitioner is presently pursuing his course in the fifth respondent College and is in the final stages of completing the 6th semester. It is further submitted that the petitioner may be permitted to continue his studies and complete the 6th semester examinations. The petitioner has also expressed his willingness to join another college for completing the remaining course after the completion of the 6th semester. 3/8
4.The petitioner further undertakes before this Court that he will not indulge in any political activities within the campus and will not interfere with the administration of the fifth respondent College. The petitioner has also agreed to abide by any conditions that may be imposed by the fifth respondent College in this regard. 5.In view of the above submissions and considering the fact that the petitioner is at the stage of completing the 6th semester, this Court is of the opinion that an opportunity may be granted to the petitioner to complete the current semester course.
6.Accordingly, subject to the petitioner filing an undertaking affidavit incorporating the above conditions, the fifth respondent College shall permit the petitioner to appear for the examinations of the 6th semester and complete the semester course.
7.After completion of the 6th semester, the fifth respondent College shall issue a No Objection Certificate (NOC) to the petitioner to enable him to pursue the remaining course in any other college. 4/8
8.In view of the above, the impugned order is set aside, preserving liberty to the fifth respondent College to place the petitioner under suspension in the event the petitioner involves himself in political activities or interferes with the administration of the College in future. 9.Cheranmahadevi Police Station shall close the Crime No.437 of 2025 and a counter case in Crime No.439 of 2025 since the petitioner and the professor of the Respondent No.5 have mutually agreed to withdraw all the allegations against each other. 10.With the above directions, this Writ Petition stands disposed of.
