PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, to initiate contempt proceedings against the Contemnors and punish them for the wilful disobedience of the order of the High Court in W.P.(MD)No.27596 of 2023 dated 21.11.2023.

ORDER

The instant contempt petition has been filed alleging violation of the order of this Court dated 21.11.2023 made in W.P(MD)No.27596 of 2023.

2. This Court by an order dated 21.11.2023 in W.P.(MD).No.27596 of 2023, had directed to refund the incentive increment that was already recovered from the writ petitioner. The State has filed a Writ Appeal in W.A.(MD).No. 680 of 2024 before this court. The Hon'ble Division Bench of this Court was pleased to dismiss the said writ appeal by an order dated 16.04.2024. Challenging the said order, the State has filed a Special Leave Petition before the Hon'ble Supreme Court of India. The said Special Leave Petition was also dismissed on 11.11.2024.

3. In compliance of the order of this Court dated 21.11.2023, the District Educational Officer, Theni District has passed an order dated 27.01.2025, wherein, a sum of Rs.7,26,651/- has been refunded to the writ petitioner.

4. In view of the above said circumstances, this contempt petition stands closed.
