PRAYER: Petition filed under Section 482 of the Criminal Procedure Code to direct the 1st respondent to transfer the investigation pending in Crime No.618 of 2019 from the file of the second respondent to the file of the third respondent and further direct the third respondent to complete the investigation within a time frame and file charge sheet.

O R D E R

The petitioner claims that she deposited a substantial sum of money with the fifth respondent. According to the petitioner, the fourth respondent is an agent while respondents 6 to 10 are his business associates. The fifth respondent is said to be running a chit scheme.

2.Prima facie, the complaint of the petitioner discloses offences under the Tamil Nadu Protection of Interests of Depositors https://hcservices.ecourts.gov.in/hcservices/ 1 / 2

Crl.O.P.(MD)No.4381 of 2020 Act. Therefore, in the very nature of things, it will have to be investigated only by the third respondent. In this case, the case has been registered as Crime No.618 of 2019 on the file of the second respondent.

3.I am of the view that this case will have to be necessarily investigated only by the third respondent. Therefore, the first respondent is directed to issue proceedings transferring the investigation of the case from the second respondent to the third respondent. This will be done within a period of two weeks from the date of receipt of a copy of this order.

4.With this direction, this Criminal Original Petition stands allowed.
