ORDER : The Court Made the following order :- The petitioner/ accused apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 465, 467 and 471 of IPC in Crime No.111 of 2018, seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl Side) appearing for the respondent.

3.The petitioner is running a travel agency and his vehicles are given on hire to Koodankulam Nuclear Power Project Limited. It came to be known that as many as 31 vehicles, given by the petitioner on hire to the Central Government, were not having valid insurance cover. Therefore, the present complaint was lodged. 4.When the matter was taken up for hearing the learned counsel appearing for the petitioner submitted that it is true that 31 vehicles of the petitioner were not having proper insurance coverage. The reason for not having the valid insurance coverage was that the petitioner was cheated by the insurance agent. He further pointed out that as on date all the vehicles are having insurance coverage. The case against the petitioner is based entirely on documentary evidence and custodial interrogation is not https://hcservices.ecourts.gov.in/hcservices/

necessary. That apart the petitioner is said to have given a complaint against the insurance agent and the same was also being enquired by the Kottar Police Station.

5.Taking note of the all aspects, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Valliyoor, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
