ORDER

This Criminal Original petition is filed for issuing a direction to the respondent herein to expedite the investigation in Crime No.229 of 2012, dated 07.06.2012 on the file of the respondent herein and to file a final report within a time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is stated that the complaint was lodged by the petitioner and the same was registered for the offences under Sections 294(b) and 506(ii) of I.P.C. It is stated by the petitioner that there is no further investigation and that therefore the petitioner was constrained to file this petition before this Court.

4. Learned Additional Public Prosecutor on instructions submitted that the complaint was enquired into and closed as "Mistake of Fact" even on 07.06.2012. He further submitted that R.C.S. Notice was also served.

5. However, learned counsel for the petitioner states that the petitioner has not received any R.C.S. Notice.

6. Today, the learned Additional Public Prosecutor handed over the copy of the closure report as well as the R.C.S.Notice to the learned counsel for the petitioner.

7. Recording the fact that the complaint itself was closed as "Mistake of Fact", the Criminal Original petition is closed. It is open to the petitioner to file Protest petition. Sd/- Assistant Registrar (CS-III) /True copy/ Sub Assistant Registrar To
