O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to direct the respondents to premature release the petitioner's husband namely Kanagaraj CP No.8995, son of Rajendrakumar aged about 37 years now lodged and confined at Central Prison, Madurai more than five years on the basis of remission under the Tamil Nadu Prison Rules,2024 by considering the representation dated 20.01.2026 in accordance with law within the time stipulated by this Court.
2. The petitioner is the wife of the convict namely Kanagaraj aged about 37 years. The husband of the petitioner was convicted in S.C.No.227 of 2010 for the offence under Section 376 of IPC and sentenced to undergo ten years rigorous imprisonment. Aggrieved over the same, the convict has
preferred an appeal before this Court in Crl.A(MD) No.220 of 2016 and this Court confirmed the sentence, however modified the sentenced to seven years. The husband of the petitioner is in jail for more than five years. At this juncture the petitioner submitted representation seeking premature release for her husband which is pending on the file of the fourth respondent for consideration, therefore the petitioner was constrained to file this petition.

The learned Additional Public Prosecutor on instructions submitted that the persons convicted under life imprisonment alone was eligible for premature release and as such the representation submitted by the petitioner cannot be considered. He further submitted that the husband of the petitioner is entitled for remission depending upon the marks secured by him based on his conduct during the imprisonment.
4. In view of the same, the fourth respondent is directed to dispose the representation submitted by the petitioner with regard to remission, if the convict is eligible and pass orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
5.With the above direction, the Writ Petition(Crl.) stands disposed of.
