Prayer in CRL RC(MD) No.1279 of 2023 This Civil Revision case is filed under sections 397 r/w 401 of the Cr.P.C., to take this revision petition on the file and call for the records from the lower appellate court and allow the revision petition by setting aside the first condition of the order, imposed for suspension of sentence, to deposit 20% of the compensation amount within a month dated 06.10.2023 in Cr.M.P.No.5742 of 2023 in Crl.A.99 of 2023, on the file of the Principal District and Sessions Judge, Madurai. ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon 1/4

hearing the arguments of Mr.S.Senthilkumar Advocate for the Petitioner this Court made the following order:

"This case has been listed today under the caption 'for extension of time'.

2. This Court while disposing the criminal revision in Crl.RC (MD) No.1279 of 2023 dated 30.11.2023, has directed the revision petitioner to deposit 20% of the compensation amount before the learned Judicial Magistrate No.1, Fast Track Court at Magistrate Level, Madurai, within a period of four weeks from the date of receipt of a copy of that order.

3. Today, when the matter was taken up for hearing, the learned counsel for the petitioner submits that the petitioner, an octogenarian, who has undergone three surgeries, could not mobilise the funds to deposit the aforesaid maintenance amount within the stipulated time frame as directed by this Court by its order dated 30.11.2023 and thereby, he has sought for extension of time to deposit the said amount.

4. Considering the submissions made by the learned counsel for the petitioner, this Court is inclined to grant further 2/4

time and accordingly, two weeks time is granted to the petitioner for depositing 20% of the compensation amount before the learned Judicial Magistrate No.1, Fast Track Court at Magistrate Level, Madurai. It is made clear that no further extension of time will be granted to the petitioner in this regard."
