ORDER

This Writ Petition has been filed seeking a direction to the first respondent herein to consider the Revision Petition filed by petitioner dated 04.02.2024 in Na.Ka.B5/3125/2024 on merits and in accordance with law and to dispose the same.

2. By consent, this Writ Petition is disposed of at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 2 and 3, notice to the respondents 2 and 3 is hereby dispensed with.

4. The petitioner claims to be the daughter of Veerapathira Pillai. The third respondent, who is a distant relative of the wife of late.Veerapathira Pillai, allegedly colluded with the second respondent to create fraudulent records and obtain a false legal heirship certificate for the petitioner's father. Hence, the petitioner approached the Revenue Divisional Officer, Devakottai, challenging the Tahsildar's order, granting the legal heirship certificate. However, the Revenue Divisional Officer rejected the petitioner's petition on the ground of laches.

Subsequently, the petitioner filed a revision before the first respondent on 04.02.2024 and the first respondent conducted an enquiry. However, there has been no significant progress in the matter. Therefore, the petitioner sent a detailed representation dated 17.11.2024, seeking early disposal of the said revision. However, the same has not been considered so far. Hence, the present Writ Petition.

5. Heard the learned counsel appearing for the parties.

Considering the facts and circumstances of the case, this Court directs the first respondent herein to consider the petitioner's Revision Petition, dated 04.02.2024, on its own merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, the respondents 2 and 3 as well as all other persons, who may be interested in the subject matter, within a period of two months from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the first respondent to consider the same on its own merits.

7. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
