ORDER

The petitioners seek for a direction to the 3rd respondent not to harass the petitioners under the guise of enquiry on the foisted compliant of the 4th respondent.

2. The learned counsel for the petitioners submitted that the third respondent police is subjecting the petitioners to harassment. He further submitted that the second petitioner is the daughter-in-law of the first petitioner and the first petitioner is a senior citizen, a heart patient, who is running a lodge in the name and style of 'Roja Lodge'. The 4th respondent, who is the son of the first petitioner's brother, without any right over the property comprised in S.Nos. 557/19, 557/19B, 557/1B2, 557/19C1, 557/19C2 of Singampunari Village has illegally created fraudulent documents and attempted to obtain the said properties. In this regard, the first petitioner has already lodged a complaint before the District Crime Branch, Sivagangai, and also filed suits in OS No.15 of 2020, 39 of 2022, 20 of 2024 and 3 of 2019 before the District Munsif Court, Singampunari. Certain other civil suits are also pending before 2/6

the District Additional Sessions Court, Sivagangai, and all the cases are pending adjudication. In the meanwhile, on 13.02.2026, only to grab the property, the fourth respondent lodged a false complaint before the third respondent police. Having received the said complaint, the third respondent police called the petitioners through phone and directed them to appear before them and they are subjecting to harassment without following any procedure as held by the Hon'ble Supreme Court and hence, this petition came to be filed.

The learned Government Advocate appearing for the respondent police categorically contended that the building situated in S.No. 557/1B2 of Singampunari Village is nothing but the office of an organization. The petitioners barged into the property and caused damage thereto. It is only in this regard that a complaint has been given. However, no action has been taken by the 3rd respondent, and in fact, no harassment has been caused to the petitioners at all.

4. The learned Government Advocate appearing for the respondent police further submitted that regarding the property dispute between the 4th respondent, who is the brother's son of the first petitioner and the first petitioner, already as many as seven criminal cases have been registered as 3/6

against both the parties, on receipt of 21 complaints against each other. Till date, 66 current paper complaints have been received from the respective parties, and both parties have frequently been called for enquiry for the purpose of closing the current papers entries. In this regard, four writ petitions and two writ appeals are pending.

5. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

6. It is not in dispute that several civil cases are pending between both parties. In such circumstances, the respondent police are advised not to meddle in the civil dispute. The petitioners and the fourth respondent are directed to resolve their disputes before the appropriate civil court.

7. With the above direction, this Criminal Original Petition is disposed of.
