Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the 1st respondent to consider and dispose of the petitioner's representations dated 27.08.2016 22.02.2017 and 27.12.2018 for regularization of the service of the petitioner in the post of part time Sweeper in the light of the order in Maa.AA.533/2014/Na.Ka.No.P1/50862/2012, dated 25.02.2014 of the 4th respondent after treating the period of dismissal from 01.10.2004 to 12.11.2009 as leave on loss of pay.

This writ petition has been filed seeking a direction to the respondents to consider the petitioner's representations dated 27.08.2016, 22.02.2017 and 27.12.2018 for regularization of service of the petitioner in the post of part time Sweeper, in the light of the order of the fourth respondent dated 25.02.2014, after https://hcservices.ecourts.gov.in/hcservices/

treating the period of dismissal from 01.10.2004 to 12.11.2009 as leave on loss of pay.

2.The petitioner was initially served with an order of dismissal dated 17.03.2005 by the fourth respondent and without challenging the same, the petitioner has simply sent representations and now filed this writ petition, seeking mandamus for consideration. Therefore, the relief sought for by the petitioner cannot be granted.

3.At this juncture, the learned counsel appearing for the petitioner seeks liberty to challenge the order of dismissal dated 17.03.2005 issued against the petitioner.

4.In such view of the matter, this writ petition is closed, granting liberty to the petitioner to challenge the dismissal order before the appropriate authority, if she is so advised. No costs. Consequently, WMP(MD)No.1355 of 2019 is closed.
