ORDER : The Court Made the following order :- The petitioner is arrayed as accused, who was arrested and remanded to judicial custody on 09.06.2016 for the alleged offences punishable under Sections 6(4) of Tamil Nadu Scheduled Commodities (RDCS) Order 1982 and Section 7(1)(a)(ii) of Essential Commodities Act, 1965, in Crime No.77 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused persons smuggled 352 bags of PDS Rice, each containing 50 Kgs. On complaint, case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and the petitioner is working as salesman and prays for bail in favour of the petitioner.
4.The learned Government Advocate (crl.side) filed counter affidavit and submitted that A1 already arrested and detained under Act 14 of 1982. The Special Tahsildar on inspection found 352 bags of PDS Rice, which was kept at the centre of Salt bags. The seized 17.440 Metric Tonnes of PDS rice in 352 bags were handed over to Tamil Nadu Civil Supplies Corporation, Port Godown, Thoothukudi. A1 confessed that, he purchased 73 bags of PDS rice from Levidas Aloy @ https://hcservices.ecourts.gov.in/hcservices/
Aloy, Salesman of Thirespuram fair price shop, where the petitioner is working as salesman and 127 bags of PDS rice from three ration shops from the opposite side to Corporation Marriage Hall. 5.Considering the serious allegation that huge quantity of PDS rice is smuggled, this Court is not inclined to grant bail to the petitioner.
