Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 465, 467, 468 and 471 of I.P.C., in Crime No.Not Known of 2017, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner was working as Junior Assistant in the College. He was appointed to collect fees from the Student's Committee. Accordingly, the petitioner collected a huge amount to the tune of Rs.36,22,460/- (Rupees Thirty Six Lakhs Twenty Two Thousand Four Hundred and Sixty only) from the Student's Committee. The petitioner mentioned correct amount in the original copy. However, the petitioner has fabricated the carbon copy which was given to the Student's Committee. On complaint, the Students Management Committee verified both the original copy and the carbon copy. On verification, it is found that the petitioner has misappropriated a sum of Rs.36,22,460/- (Rupees Thirty Six Lakhs Twenty Two Thousand Four Hundred and Sixty only). Thereafter, the College Committee lodged a complaint before the respondent police against the petitioner.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he did not commit any offence as alleged by the prosecution. He further submitted that the petitioner has given a complaint for mis-practice of illegal amount collected from the Students' Committee and the case has been filed against them in order to wreck vengeance.

4.The learned Government Advocate (Crl.side) appearing for the state would submit that there was a prima facie against the petitioner for committing the alleged offences under Section 420 of I.P.C., and there was also comparison between the original copy and the carbon copy.
5.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl.side), I am not inclined to grant anticipatory bail to the petitioner.
